1. Services Provided

FBARfiling.us.com, operated by Nixon Labs, LLC, provides an online platform to assist individuals and entities in preparing and electronically filing the Report of Foreign Bank and Financial Accounts (FBAR), also known as FinCEN Form 114, with the Financial Crimes Enforcement Network (FinCEN). We are not affiliated with, endorsed by, or connected to FinCEN, the U.S. Department of the Treasury, or any other government agency.

2. Service Fee

The fee for our FBAR preparation and filing service is $327 per filing. This fee covers the preparation of your FBAR based on the information you provide, electronic filing with FinCEN through the BSA E-Filing system, and basic support related to your filing.

3. Payment Terms & Refund Policy

Payment is required at the time of submission. All payments are non-refundable once the filing process has begun. By submitting payment, you acknowledge and agree that no refunds will be issued regardless of the outcome of your filing.

4. Filing Process & Authorization

By using our service, you authorize Nixon Labs, LLC to file the FBAR on your behalf with FinCEN through the BSA E-Filing system. You certify that all information provided is accurate, complete, and truthful. You understand that you remain legally responsible for the contents of your FBAR filing.

5. Incomplete or Unpaid Submissions

If a submission is incomplete or payment is not received, we reserve the right to not file your FBAR. Any data associated with incomplete or unpaid submissions may be deleted from our systems after a reasonable period of time.

6. Completed Submissions & Record Retention

For completed and paid submissions, we will retain a copy of your filing information for a period of six (6) years from the date of filing, consistent with FinCEN record retention requirements. After this period, your data may be securely deleted.

7. User Responsibilities

You are responsible for ensuring the accuracy and completeness of all information provided. You must have the legal authority to file the FBAR for the account(s) reported. You are responsible for maintaining copies of your filing confirmation and any supporting documentation.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Nixon Labs, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed the amount of the service fee paid by you.

11. Indemnification

You agree to indemnify and hold harmless Nixon Labs, LLC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising out of or related to your use of our services, your violation of these terms, or the information you provide.

12. Termination of Services

We reserve the right to terminate or suspend access to our services at any time, without prior notice, for conduct that we believe violates these Terms & Conditions or is harmful to other users or our business interests.

13. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Florida.

14. Electronic Communications

By using our services, you consent to receive electronic communications from us regarding your filing, account, and service updates. These communications may include email confirmations, filing status updates, and important notices.
